GST Annual Return Filing – GSTR-9

Form GSTR-9 is the annual return for eligible regular GST taxpayers. It consolidates details of outward and inward supplies, input tax credit, tax paid, refunds, demands, and other transactions reported for a financial year.

Accurate annual-return filing requires reconciliation of GSTR-1, GSTR-3B, auto-populated GST data, books of account, and financial statements. Differences should be investigated before the return is filed because a filed GSTR-9 cannot ordinarily be revised.

What is Form GSTR-9?

GSTR-9 is an annual consolidated return under Section 44 of the CGST Act for registered persons to whom the annual-return requirement applies. It summarises the supplies, input tax credit, tax payments, refunds, demands, and specified disclosures for the relevant financial year.

The return is prepared GSTIN-wise. A person holding registrations in more than one State or Union Territory must determine and complete the requirement separately for each GSTIN.

GSTR-9 is not a substitute for monthly or quarterly returns. The applicable GSTR-1 and GSTR-3B returns for the year must first be furnished, and their data should be reconciled with the books before annual filing.

GSTR-9 Applicability

Form GSTR-9 generally applies to regular taxpayers, including eligible SEZ units and SEZ developers, who were registered for any period during the financial year. The exact requirement must also be checked against the exemption notification issued for that year.

  • Regular Taxpayers: Businesses and professionals registered under the normal GST scheme.
  • SEZ Registrants: Eligible SEZ units and developers registered as regular taxpayers.
  • Scheme Changes: Taxpayers who moved between the composition and regular schemes may have form-specific obligations for the relevant portions of the year.
  • Multiple GSTINs: Applicability and turnover must be reviewed at the PAN level, while the return is filed separately for each applicable GSTIN.

The Government has granted annual exemptions to registered persons whose aggregate turnover does not exceed the notified limit, commonly ₹2 crore for recent financial years. Taxpayers should verify the notification for the particular year instead of treating the limit as a permanent exemption.

Persons Generally Excluded from GSTR-9

  • Input Service Distributors.
  • Persons required to deduct tax at source under Section 51.
  • Persons required to collect tax at source under Section 52.
  • Casual taxable persons.
  • Non-resident taxable persons.
  • Other persons specifically exempted by the Act, rules, or a notification for the relevant financial year.

Composition taxpayers do not file GSTR-9. For periods from FY 2019-20 onward, their annual-return reporting is generally handled through Form GSTR-4 under the prevailing composition-return framework, rather than the older GSTR-9A process.

GSTR-9C Reconciliation Statement

A registered person whose aggregate turnover exceeds ₹5 crore during a financial year is generally required to furnish Form GSTR-9C along with the annual return. GSTR-9C reconciles the figures reported in GSTR-9 with the annual financial statements.

  • GSTR-9C is now self-certified by the taxpayer under the current framework.
  • Mandatory certification by a Chartered Accountant or Cost Accountant is no longer the general statutory requirement.
  • Turnover is evaluated on an aggregate, PAN-based basis, while reconciliation is prepared for the relevant GSTIN.
  • Where GSTR-9C applies, the annual-return obligation is complete only when the applicable GSTR-9 and GSTR-9C requirements are fulfilled.

Due Date for GSTR-9

The statutory due date is ordinarily 31 December following the end of the relevant financial year. For example, the ordinary due date for a financial year ending on 31 March is 31 December of that calendar year. The Government may extend the date through a notification, so the deadline displayed on the GST Portal and current notifications should be checked before filing.

Structure of Form GSTR-9

Part I: Basic Details

Contains the financial year, GSTIN, legal name, and trade name. Core registration details are generally auto-populated by the GST Portal.

Part II: Outward and Inward Supplies

Reports supplies on which tax is payable and supplies on which tax is not payable, including taxable supplies, exports, SEZ supplies, exempt supplies, nil-rated supplies, and non-GST supplies, as applicable.

Part III: Input Tax Credit

Provides details of ITC availed, reversed, ineligible, reclaimed, and other prescribed ITC comparisons based on returns and auto-populated data.

Part IV: Tax Paid

Summarises tax, interest, late fee, penalty, and other amounts payable and paid for the financial year based on the returns filed.

Part V: Previous-Year Transactions Reported Later

Captures specified transactions of the relevant financial year declared in returns of the next financial year up to the statutory reporting period.

Part VI: Other Information

Includes demands and refunds, supplies from composition taxpayers, deemed supplies, HSN-wise summaries, and late-fee information, as required by the form for that year.

Documents and Records Required

  • GSTR-9C reconciliation and supporting workings where the turnover threshold is crossed.

Prerequisites for Filing GSTR-9

  • The taxpayer must have been registered as a regular taxpayer for at least part of the relevant year.
  • All applicable GSTR-1 and GSTR-3B returns for the financial year should be filed.
  • Books and financial statements should be finalised sufficiently to complete the annual reconciliation.
  • Differences in turnover, tax liability, ITC, reverse charge, exports, and amendments should be identified and documented.
  • An authorised signatory and the appropriate DSC or EVC facility must be available.

Some fields are auto-populated and may be non-editable. Auto-filled figures should still be checked against returns and records; their appearance on the Portal does not establish that the underlying treatment is correct.

How to File GSTR-9 Online

Step 1: Review Applicability

Confirm the GSTIN's registration status, PAN-based aggregate turnover, notified exemption, and whether Form GSTR-9C also applies.

Step 2: Complete Periodic Returns

Ensure every applicable GSTR-1 and GSTR-3B return for the financial year has been filed before beginning the annual return.

Step 3: Reconcile the Records

Compare return data with sales, purchases, ITC statements, ledgers, e-invoices, financial statements, exports, refunds, and demands. Investigate every material difference.

Step 4: Open the Annual Return

Log in to the official GST Portal, choose Services, Returns, and Annual Return, and select the relevant financial year.

Step 5: Choose Nil or Normal Filing

A nil GSTR-9 may be selected only when all Portal conditions are satisfied, including no outward or inward supplies, ITC, refund, liability, demand, or late fee for the year.

Step 6: Download System Summaries

Download and review the GSTR-9 system-computed summary and available GSTR-1, GSTR-3B, and Table 8A details before completing the form's tables.

Step 7: Complete and Validate the Tables

Enter the applicable details, explain or retain workings for variances, save every section, and verify totals across the six parts.

Step 8: Preview the Draft

Generate the PDF or Excel preview and conduct a final review. Once filed, Form GSTR-9 cannot ordinarily be changed.

Step 9: Compute Liabilities

Use the Portal to compute late fee, if any, and pay it through the electronic cash ledger. Additional tax liability disclosed through annual reconciliation is generally paid using Form GST DRC-03 as applicable.

Step 10: Sign and File

Select the declaration and authorised signatory, then file using DSC or EVC. Save the ARN and filed PDF or Excel for the records.

Late Fee and Additional Liability

Filing after the applicable due date can attract a late fee under Section 47, subject to the statutory rate, turnover-based relief or caps, and notifications applicable to the financial year. The Portal computes the late fee during filing, and it must generally be paid in cash before submission.

The annual return cannot be used to claim additional ITC. Where the reconciliation reveals unpaid tax, the taxpayer should evaluate and discharge the liability with applicable interest through the prescribed mechanism, including Form GST DRC-03 where appropriate.

Common GSTR-9 Filing Errors

  • Using GSTR-1 turnover without reconciling it with GSTR-3B and the books.
  • Ignoring amendments, credit notes, advances, and previous-year transactions reported later.
  • Claiming that auto-populated ITC is automatically eligible.
  • Reporting exports, SEZ supplies, exempt supplies, or reverse-charge transactions in the wrong tables.
  • Failing to reconcile tax paid through cash and input tax credit.
  • Overlooking GSTR-9C because turnover was reviewed GSTIN-wise instead of on the prescribed aggregate basis.
  • Filing without previewing the return, even though it cannot ordinarily be revised afterward.
