RERA Registration for Agents

RERA Registration, short for Real Estate Regulatory Authority Registration, is a mandatory legal requirement for real estate developers and agents operating in India. It promotes transparency, accountability, and fairness in the real estate sector while protecting the interests of property buyers and encouraging ethical business practices.

Real estate professionals must obtain RERA Registration before advertising, marketing, booking, selling, or facilitating the sale of properties covered under the Real Estate (Regulation and Development) Act.

LegallensIndia simplifies the entire RERA Registration process by helping you prepare the required documentation, complete the application accurately, and obtain your RERA Registration Certificate with ease.

What is RERA Registration?

RERA Registration is a mandatory registration governed by the Real Estate (Regulation and Development) Act. It was introduced to regulate the real estate sector by promoting transparency, accountability, and efficiency in property transactions.

Under the RERA Act, developers and real estate agents must obtain registration before advertising, marketing, booking, selling, offering for sale, or inviting investments in plots, apartments, or buildings covered by the Act.

Objectives of RERA Registration

The Real Estate (Regulation and Development) Act was introduced to improve transparency and regulate the functioning of the real estate sector across India.

  • Ensuring transparency in real estate transactions.
  • Promoting accountability and reducing fraudulent business practices.
  • Safeguarding the interests of both real estate developers and property purchasers.
  • Regulating the registration and approval of residential and commercial real estate projects.
  • Monitoring the sale and purchase of real estate properties under the provisions of the RERA Act.

Role and RERA Agent Registration Requirements for Real Estate Agents

A real estate agent is a person who represents buyers, sellers, or developers in real estate transactions and earns remuneration for facilitating such transactions. Real estate agents include brokers, property dealers, consultants, and intermediaries involved in the sale or lease of land, plots, buildings, or apartments.

Under the Real Estate (Regulation and Development) Act, every real estate agent dealing with properties covered under the Act must obtain RERA Registration before conducting any real estate activities. This registration ensures that agents operate legally while maintaining transparency and professionalism in the real estate market.

RERA Agent Registration Applicability

The Real Estate (Regulation and Development) Act specifies the categories of promoters, projects, and real estate agents that are required to obtain RERA Registration before carrying out their activities.

  • Promoters, real estate projects, and real estate agents are subject to RERA Registration.
  • RERA applies to commercial projects, residential projects, and plotted developments.
  • Builders proposing commercial or residential developments on land exceeding 500 square meters or consisting of more than eight apartments must obtain RERA Registration.
  • Real estate agents involved in the sale or purchase of properties are required to obtain a RERA Registration Certificate.
  • Registration is mandatory for projects having a total development area exceeding 500 square meters or more than eight apartments across all phases.
  • Real estate agents selling or transferring plots, apartments, or buildings in RERA-registered projects must hold valid RERA Registration.
  • Individuals or entities engaged in advertising, marketing, booking, selling, offering for sale, or inviting investments in properties covered under the RERA Act must obtain RERA Registration.
  • A RERA Registration Certificate remains valid throughout the respective state in which it is issued.
  • The applicability of RERA extends to all eligible parties involved in real estate transactions as specified under the Act.

Advantages of RERA Registration for Real Estate Agents

Obtaining RERA Registration offers several benefits to real estate agents while ensuring compliance with the Real Estate (Regulation and Development) Act.

  • Legal Authorization: Enables agents to legally advertise, market, book, sell, and facilitate transactions in RERA-registered projects.
  • Enhanced Credibility: Improves the professional reputation of registered agents and builds confidence among buyers, sellers, and developers.
  • Consumer Protection: Promotes transparency, accountability, and fair business practices while protecting the interests of property buyers.

Validity of RERA Registration

A RERA Registration Certificate issued to a real estate agent remains valid for a specified period, subject to compliance with the provisions of the RERA Act.

  • The registration of a real estate agent is valid for five years, unless revoked before its expiry.
  • Registered agents are required to maintain proper books of accounts, records, and financial statements as prescribed by the regulatory authority.
  • Proper record maintenance ensures transparency, accountability, and regulatory compliance in business operations.

Renewal of RERA Registration

A real estate agent may continue operating beyond the validity period by applying for the renewal of the RERA Registration Certificate.
