Trademark Renewal

A registered trademark distinguishes a brand and protects its identity, but registration must be renewed periodically to remain in force. Timely renewal preserves statutory rights, commercial value, and the official Registry record connected with the mark.

In India, a trademark registration is generally valid for 10 years and may be renewed for successive 10-year periods. Missing the ordinary renewal deadline can lead to surcharge, removal, restoration proceedings, additional cost, and uncertainty for the brand.

LegallensIndia helps trademark proprietors verify renewal dates, review ownership records, prepare Form TM-R, pay the applicable fee, address Registry discrepancies, and monitor renewal or restoration through completion.

What is a Trademark?

A trademark is a distinctive word, name, logo, symbol, phrase, design, label, shape, packaging feature, sound, colour combination, or other eligible sign that identifies the commercial source of goods or services.

A registered trademark is an intangible business asset. It can support enforcement, licensing, franchising, assignment, investment, customer recognition, and long-term brand value, provided the registration is properly maintained.

What is Trademark Renewal?

Trademark Renewal is the procedure for extending an existing registration for another 10-year term. The registered proprietor or authorised representative files Form TM-R with the prescribed fee and accurate registration particulars.

A renewal request may generally be filed up to one year before expiry. If the registration expires without ordinary renewal, the proprietor may still seek renewal with surcharge within six months after expiry. Restoration and renewal may be requested within one year from expiry when the statutory conditions are met.

Renewal extends the existing registered rights; it is not an opportunity to replace the registered mark with a materially different mark. Ownership changes, proprietor details, and permitted alterations may require separate recordal procedures.

Trademark Renewal under Section 25

Section 25 of the Trade Marks Act, 1999 provides for the duration, renewal, removal, and restoration of registered trademarks. On receipt of a valid renewal request and prescribed fee, the Registrar renews the registration for another 10-year period.

  • Each renewal extends the registration for 10 years.
  • Renewal can continue for successive 10-year periods without a fixed maximum number.
  • The request is filed in Form TM-R under the Trade Marks Rules, 2017.
  • The official fee depends on the applicable filing method and fee schedule.
  • The mark must not have been cancelled, removed, or made non-renewable by a competent order.
  • Renewal and restoration are recorded and advertised by the Trade Marks Registry.

Trademark Renewal Timeline

PeriodAvailable Action
Up to one year before expiryFile an ordinary renewal request in Form TM-R with the prescribed renewal fee.
Before expiryComplete renewal early to avoid surcharge and continuity risk.
Within six months after expiryRequest renewal in Form TM-R with the prescribed surcharge before removal, subject to the Act and Rules.
Within one year from expiryApply for restoration and renewal in Form TM-R when the registration has been removed and the statutory requirements are satisfied.
After the restoration windowRestoration may no longer be available; a fresh application and broader legal strategy may need consideration.

Removal for Non-Renewal

Where the prescribed renewal form and fee are not received, the Registrar sends a notice concerning the approaching expiration and renewal conditions in accordance with the Trade Marks Rules.

If renewal is not completed, the Registrar may remove the trademark from the register and advertise the removal in the Trademark Journal. The registration should not be removed where a valid surcharge request is made in Form TM-R within six months from expiry.

Removal can interrupt statutory protection and create enforcement, licensing, investment, marketplace, and ownership risks. Proprietors should therefore maintain their own deadline records rather than rely solely on receiving a Registry reminder.

Benefits of Renewing a Trademark

  • Continued Legal Protection: Renewal keeps the statutory registration active for another 10-year term.
  • Exclusive Brand Rights: The proprietor continues to hold the registered rights for the covered goods or services.
  • Infringement Enforcement: An active registration supports legal action against prohibited unauthorised use.
  • Brand Recognition: Continuity helps preserve consumer association, reputation, and goodwill.
  • Licensing and Franchising: A valid registration can be licensed or included in franchise arrangements.
  • Assignment and Transfer: The trademark remains a transferable intellectual property asset.
  • Commercial Value: A maintained trademark portfolio can support investment, due diligence, finance, and business valuation.
  • Opposition Rights: The proprietor can rely on the renewed registration against later conflicting applications.
  • Marketplace Protection: Active registration can support e-commerce, domain, advertising, and anti-counterfeiting complaints.
  • Avoidance of Restoration Cost: Timely renewal prevents surcharge, restoration fees, and avoidable procedural uncertainty.

Can a Trademark Be Changed During Renewal?

Renewal ordinarily continues the registration as it appears on the register. It does not permit substitution of a new trademark or a material alteration of the registered mark.

  • Renewal without Alteration: The existing mark and registered scope are renewed for another term.
  • Proprietor Detail Changes: A name or address change should be recorded through the applicable separate procedure.
  • Ownership Transfer: An assignment or transmission requires separate recordal of the new proprietor.
  • Minor Permitted Alteration: Any alteration must satisfy the Trade Marks Act and generally requires a separate application and Registry approval.
  • Materially Different Mark: A fresh trademark application is usually required where the business wants protection for a substantially changed logo, word, or design.

Restoration of a Removed Trademark

If a trademark is removed for failure to pay the renewal fee, the proprietor may apply for restoration and renewal in Form TM-R within one year from the expiration of the registration.

Restoration is discretionary. The Registrar considers the circumstances of the delay and the interests of other affected persons and may impose conditions or limitations when restoring the registration.

Review the Registration Status

Confirm the expiry date, removal status, proprietor details, relevant Journal entries, and whether the one-year restoration period remains open.

Prepare Form TM-R

Complete the restoration-and-renewal request with the correct registration particulars and relief sought.

Explain the Delay

Provide an accurate explanation and any supporting material required to show why renewal was not completed on time and why restoration should be allowed.

Pay Restoration and Renewal Fees

Submit the government fees prescribed for restoration, renewal, and any applicable surcharge through the authorised filing channel.

Respond to Registry Concerns

Address any discrepancy, objection, third-party interest, condition, or hearing direction raised during consideration of the request.

Restoration and Journal Advertisement

If allowed, the Registry restores and renews the mark, updates the record, notifies relevant parties, and advertises the restoration and renewal in the Trademark Journal.

Documents Required for Trademark Renewal

Renewal is filed using Form TM-R rather than the former TM-12 form. Commonly required information and documents include:

  • Trademark registration number and class details.
  • Copy of the registration certificate or current register extract.
  • Current name, address, legal status, email, and contact details of the proprietor.
  • Identity and address proof where required.
  • Business incorporation or registration records for an entity proprietor.
  • Copy or details of the original trademark application where needed.
  • Power of attorney or representative authorisation.
  • Assignment, transmission, merger, or name-change documents if ownership details require recordal.
  • Explanation and supporting documents for restoration, where applicable.
  • Payment details for renewal, surcharge, or restoration government fees.

Trademark Renewal Online Procedure in India

Step 1: Check the Trademark Record

Verify the registration number, proprietor, classes, expiry date, active status, registered users, assignments, limitations, and any pending proceeding before filing.

Step 2: Determine the Correct Request

Identify whether the matter is an ordinary renewal, renewal with surcharge within six months after expiry, or restoration and renewal within one year from expiry.

Step 3: Update Ownership Records

Where the proprietor name, address, or ownership has changed, assess whether a separate recordal request should be filed before or alongside renewal.

Step 4: Prepare Form TM-R

Complete the current renewal or restoration form with accurate registration details, address for service, proprietor information, and the appropriate request type.

Step 5: Pay the Prescribed Fee

Pay the government fee applicable to ordinary renewal, late renewal with surcharge, or restoration and renewal. Fees should be checked against the official schedule in force on the filing date.

Step 6: File Online

Submit Form TM-R and the required supporting documents through the Trade Marks Registry's authorised electronic filing system and retain the acknowledgement and payment receipt.

Step 7: Registry Review

The Registry checks whether the mark is renewable, the request is timely, the proprietor details are consistent, the correct fee has been paid, and any outstanding discrepancy requires action.

Step 8: Respond to a Discrepancy

If the Registry raises an issue, provide the required clarification, correction, document, fee, or hearing response within the period specified.

Step 9: Renewal Record and Advertisement

Once allowed, renewal is recorded for a further 10 years. The Registry sends notice to the proprietor and registered users and advertises renewal or restoration and renewal in the Trademark Journal.

Trademark Renewal Fees

The total cost can include the official renewal fee, professional service charges, and—where the deadline has passed—a surcharge or restoration fee. Separate charges may apply for ownership corrections, assignment recordal, hearings, or other related proceedings.

Government fees can change and may differ by filing mode or request type. LegallensIndia reviews the registration status and provides a transparent quotation before filing.

Common Trademark Renewal Mistakes

  • Relying entirely on the Registry reminder rather than maintaining an internal deadline.
  • Confusing the application date, registration date, and renewal due date.
  • Using an obsolete form instead of current Form TM-R.
  • Filing in the wrong proprietor name after an unrecorded assignment or merger.
  • Ignoring an outdated address for service or representative record.
  • Paying the ordinary fee after expiry when surcharge or restoration fees apply.
  • Assuming a materially changed logo can be substituted through renewal.
  • Failing to renew every relevant class or associated registration in a portfolio.
  • Missing a Registry discrepancy notice after filing.
  • Waiting beyond the one-year restoration period.
